국가배상법 제7조는 외국인에 대한 책임 규정이다.

Article 7 of state compensation act stipulates the liability for alien.

이 조항은 “이 법은 외국인이 피해자인 경우에는 해당 국가와 상호 보증이 있을 때에만 적용한다.”고 규정하고 있다.

This article stipulates “This Act shall apply only in cases where a mutual guarantee with a corresponding nation exists, if a victim is an alien.”

이렇듯 국가배상법이 정하는 국가 간 상호보증이 있다.

As such, there is a mutual guarantee between countries as determined by the National Reparation Act.

이 상호보증은 당해 외국에서 구체적으로 우리나라 국민에게 국가배상청구를 인정한 사례가 없더라도 가능하다.

This mutual guarantee is possible even if there is no case in which the foreign national specifically acknowledged the claim of national reparation to the Korean people.

즉 실제로 인정될 것이라고 기대할 수 있는 상태이면 충분하다.

In other words, it is sufficient to be able to expect to be recognized in practice.
