보조참가는 원고와 피고와의 사이에서 행하여지는 소송에 제3자가 일방을 보조하는 것이다.

Auxiliary participation means that a third party assists one in a lawsuit between the plaintiff and the defendant.

이를 위하여 소송절차를 현저하게 지연시키지 않는 범위에서 참가하는 것을 말한다.

To this end, participation is permitted within that the proceedings are not delayed significantly.

민사소송법 제71조는 보조참가에 관한 규정이다.

Article 71 of civil procedure act sipulates supplementary intervention.

이 조항은 “소송결과에 이해관계가 있는 제3자는 한 쪽 당사자를 돕기 위하여 법원에 계속 중인 소송에 참가할 수 있다.”고 규정하고 있다.

This article stipulates “Any third party interested in the result of a lawsuit may intervene in the lawsuit pending before the court in order to assist either party.”

다만, “소송절차를 현저하게 지연시키는 경우에는 그러하지 아니하다.”고 단서를 달고 있다.

But it has a proviso as “That the same shall not apply where it may retard the litigation procedures significantly.”
