이 시점에서 甲은 허가신청에 협력 協力할 의무를 가지고 있다.

그런데 그는 그 의무의 이행 履行을 거절하는 의사를 명백히 표시하였다.

그렇다면 甲乙 간의 계약은 확정적 確定的으로 무효가 된다.

If so, the contract between 甲乙 is definitely invalid.

마찬가지로 甲乙이 토지거래허가를 받기 전 前의 시점이라고 하자.

그렇다면 그 시점에서는 계약의 채권적 債權的 효력은 발생하지 않는다.

또한 토지거래허가를 받기 전의 시점 時點이다.

그러므로 乙이 甲에게 소유권이전의무 불이행 不履行을 물을 수 없다.

즉 계약으로 인한 손해배상청구 損害賠償請求를 할 수 없다.

In other words, he cannot claim damages compensation due to contracts.

계약 체결 후 토지거래허가 土地去來許可를 받았다면 계약은 어떻게 될까?

What will happen to the contract if the land transaction permission is granted after the contract is signed?

그럴 경우, 계약은 특별한 사정이 없는 한 소급 遡及하여 계약이 성립한 때부터 유효가 된다.

토지거래허가를 받지 못하여 계약이 확정적 確定的으로 무효가 되었다.

그런데 그 무효가 됨에 있어 귀책사유 歸責事由가 있는 자가 있다.
