신탁등기가 경료된 부동산이 있다.

이 경우에는 등기관은 그 등기신청이 신탁목적에 반하지 아니하는가를 심사하여야 한다.

만일 신탁목적에 반하는 등기신청은 이를 수리하여서는 아니 된다.

등기관은 수탁자를 등기의무자로 하는 처분제한의 등기, 강제경매등기, 임의경매등기등의 촉탁이 있는 경우에는 이를 수리한다.

The registration authority shall accept the registration of restrictions on disposition, registration of forced auctions, registration of voluntary auctions, etc., with the trustee as a registration obligation.

위탁자를 등기의무자로 하는 경우에는 수리하여서는 아니 된다.
