장래에 어떤 사실이 일어나는지에 따라 법률행위의 효력이 발생하거나 소멸하는 법률행위의 부관을 말한다.

위 예에서 ‘취직’은 효력을 발생시키는 정지조건이 되고, ‘이혼’은 효력을 소멸시키는 해제조건이 된다.

In the above example, 'employment' becomes the condition for suspension to take effect, and 'divorce' becomes the condition for cancellation to extinguish the effect.

즉, 전자는 조건성취로 법률행위의 효력이 생겨 불확실한 상태를 ‘정지’시킨다는 뜻이고, 후자는 조건성취로 법률행위의 효력이 사라져 역시 불확실한 상태를 ‘해제’시킨다는 뜻이다.

In other words, the former means that the legal action becomes effective due to the fulfillment of the condition, which means that the uncertain state is “suspended”, and the latter means that the effect of the legal action disappears due to the fulfillment of the condition, and the uncertain state is also “released”.
