Trademark Act stipulates that a trademark registration may be cancelled in a case where an exclusive or non-exclusive licensee misleads consumers as to the quality of goods or makes them confused with goods relating to another person’s business by using the registered trademark or a similar trademark on the designated goods or similar goods.

The above provision is intended to promote the safety of commodity exchange by imposing an obligation of supervision over a licensee rather than allowing a trademark right holder to freely establish the right to use, thereby constraining the licensee’s illegitimate use of the registered trademark beyond the right to use that would otherwise contravene the original purpose of the trademark system,
