민법 제844조제1항의 친생추정은 반증을 허용하지 않는 강한 추정이다.

The estimating birth under Article 844 (1) of the Civil Code is a strong presumption that does not allow disprove.

제844조(남편의 친생자의 추정) ① 아내가 혼인 중에 임신한 자녀는 남편의 자녀로 추정한다.

Article 844 (Presumption as Husband's Child) (1) A child conceived by a wife during the marriage shall be presumed to be the child of the wife's husband.

그러므로 처가 혼인 중에 포태한 이상 반증을 허용하지 않는다.

Therefore, it is not allowed to disprove in which the wife was pregnant during marriage.

다만 그 부부의 한쪽이 장기간에 걸쳐 해외에 나가 있으면 반증은 허용된다.

However, disagreement is allowed if one of the couples has been abroad for a long time.

또한 사실상의 이혼으로 부부가 별거하고 있는 경우 등도 반증은 허용된다.

In addition, disproving is allowed even when the couple is separated due to a de facto divorce.

즉 동거의 결여로 처가 부의 자를 포태할 수 없는 것이 외관상 명백한 사정이 있는 경우들이다.

In other words, there are cases in which there is a clear situation in the appearance that the wife cannot contain due to the lack of cohabitation.

그러한 경우에만 친생의 추정이 미치지 않을 뿐이다.

Only in such a case, the presumption of the ancestors does not reach.

이러한 예외적인 사유가 없는 한 누구라도 그 자가 부의 친생자가 아님을 주장할 수 없는 것이다.

Without these exceptional reasons, no one can claim that he is not the husband's child.

이와 같은 추정을 번복하기 위하여는 부가 민법 제846조, 제847조에서 규정하는 친생부인의 소를 제기하여 그 확정판결을 받아야 한다.

In order to overturn such presumption, the lawsuits stipulated in Articles 846 and 847 of the Civil Code must be filed against the denial of the husband's child and a final judgment must be obtained.
