증인신문이란 증인이 실험한 사실을 내용으로 하는 진술을 얻는 증거조사이다.

A witness questioning is a test of evidence in which a testimony is

 obtained based on the facts that a witness has tested.

즉 증인에 대한 증거조사를 말한다.

In other words, it refers to an investigation of evidence against a witness.

여기서 증인이란 법원 또는 법관에 대하여 자기가 과거에 실험한 사실을 진술하는 제3자이다.

Here, a witness is a third person who makes a statement about his

 or her past experiments to the court or judge.

법원 또는 법관에 대하여 진술하는 자이므로 수사기관에 대하여 진술하는 참고인은 증인이 아니다.

Since it is a person who makes a statement about the court or a judge, 

the reference person making a statement about the investigative

 agency is not a witness.

증인은 자기가 과거에 실험한 사실을 진술하는 자라는 점이 특색이다.

A witness is characterized by being a person who states what he has 

experimented with in the past.

따라서 특별한 지식 • 경험에 속하는 법칙이나 이를 구체적 사실에 적용하여 얻은 판단을 보고하는 감정인과 구별된다.

Therefore, it is distinguished from an appraiser who reports a law belonging

 to a particular knowledge or experience or a judgment obtained by 

applying it to a specific fact.

이점에서 증인과 감정인은 엄연히 다르다.

In this view, the witness and the appraiser are completely different.

증인이 비대체적임에 반하여, 감정인은 대체적이라는 점에 차이가 있다.

The difference is that witnesses are non-substitute, whereas appraisers are substitutes.
