사법권 독립 침해 여부가 문제되는 사례를 본다.

Here is a case where the question of whether or not the independence

 of jurisdiction is violated is questioned.

수뢰액이 5천만 원 이상인 때에는 무기 또는 10년 이상의 징역에 처하도록 ｢특정범죄 가중처벌 등에 관한 법률｣이 정하고 있다.

If the commission amount is 50 million won or more, the “Act on Aggravated

 Punishment, etc. for Certain Crimes” stipulates that a person may be sentenced 

to life or more than 10 years in prison.

이 조항은 별도의 법률상 감경사유가 없는 한 집행유예의 선고를 할 수 없도록 그 법정형의 하한을 높였다.

This provision raised the lower limit of the statutory sentence so that a sentence

 of probation cannot be imposed unless there is a separate legal reason for reduction.

그렇다고 하더라도 법관의 양형결정권을 침해하였다거나 법관독립의 원칙에 위배된다고 할 수 없다.

Even so, it cannot be said that it has violated the judge's right to decide on

 sentence or violated the principle of independence of judges.

근무성적이 현저히 불량하여 판사로서 정상적인 직무를 수행할 수 없는 경우에 연임발령을 하지 않도록 ｢법원조직법｣이 규정하고 있다.

이는 사법의 독립을 침해한다고 볼 수 없다.

이번에는 의료법 관련 조항을 본다.

비안마사들의 안마시술소 개설행위를 금지하고 있다.

The act of opening massage parlors by non-massagers is prohibited.

이 규정을 위반한 자를 처벌하는 것이 ｢의료법｣이다.

It is the “Medical Law” that punishes those who violate this regulation.

이 조항이 벌금형과 징역형을 모두 규정하고 있다.

This provision provides for both fine and imprisonment.

그러나 그 하한에는 제한을 두지 않고 그 상한만 5년 이하의 징역형 또는 2천만 원 이하의 벌금형으로 제한하고 있다.

However, there is no limit to the lower limit, and the upper limit is limited to

 imprisonment for up to 5 years or to a fine of up to 20 million won.

아울러 죄질에 따라 벌금형이나 선고유예까지 선고할 수 있도록 하고 있다.

그러나 이것은 법관의 양형재량권을 침해하는 것이 아니며 비례의 원칙에도 위배되지 않는다.
