이주대책은 ｢공익사업을 위한 토지 등의 취득 및 보상에 관한 법률｣과 직결된다.

이 법을 줄여서 ‘토지보상법’이라고 부른다.

이주대책은 헌법 제23조 제3항의 정당한 보상에 포함되는 것이라고 볼 수 없다.

The relocation countermeasures cannot be considered to be included in the 

legitimate compensation of Article 23, Paragraph 3 of the Constitution.

이는 정당한 보상에 부가하여, 이주자들에게 종전의 생활 상태를 회복시키기 위한 생활보상의 하나이다.

In addition to just compensation, this is one of the living compensations for migrants 

to restore their former living conditions.

따라서 이주대책의 실시 여부는 입법자의 입법 정책적 재량의 영역에 속한다고 볼 것이다.

Therefore, it will be considered that whether or not the immigration countermeasure 

is implemented belongs to the legislative policy discretion of the legislator.

그러므로 세입자를 이주대책대상자에서 제외하는 토지보상법 시행령 규정은 타당하다.

Therefore, the provisions of the Enforcement Decree of the Land Compensation Act, 

which excludes tenants from immigration countermeasures, are reasonable.

그것이 세입자의 재산권을 침해하는 것이라 볼 수 없다.

It cannot be seen as violating the tenant's property rights.
