첩관계인 부부생활의 종료를 해제조건으로 하는 증여계약은 그 조건만이 무효인 것이

아니라 증여계약 자체가 무효이다.

In the case of a donation contract where the termination of the concubine life is

a condition for cancellation, not only the condition is invalid, but the gift contract itself.

민법 제151조 제1항을 보면, 조건이 선량한 풍속 기타 사회질서에 위반한 것인 때에는 그

법률행위는 무효로 한다고 규정하였다.

Article 151 (1) of the Civil Code stipulates that if the condition violates good manners

and other social order, the legal act is invalid.

아울러 조건과 관련하여 조건있는 법률행위의 당사자는 조건의 성부가 미정한 동안에

조건의 성취로 인하여 생길 상대방의 이익을 해하지 못한다.

In addition, a party to a conditional legal act with respect to the condition shall not

harm the interests of the other party that will arise from the fulfillment of the

condition while the condition is not determined.

해제조건있는 법률행위는 조건이 성취한 때로부터 그 효력을 잃지만, 당사자의 의사에

따라 이를 소급하게 할 수 있다.

Legal acts subject to revocation conditions lose their effect from the time the

conditions are fulfilled, but they may be retroactive at the will of the parties.

시기있는 법률행위는 기한이 도래한 때로부터 그 효력이 생긴다.

Timely legal acts take effect from the time the deadline arrives.

기한부 권리는 일반규정에 의하여 처분할 수 있다.

Limited rights can be disposed of in accordance with general provisions.
