The court determined the amount of damages for man who suffered a disability due to

the negligence of a doctor during the operation and adopted the disability

evaluation criteria of the Korean Medical Association.

법원이 수술 도중 의사의 과실로 장애를 얻은 남성의 손해배상액을 산정하며 대한의학회

장애평가 기준을 채택한 판결을 내놨다.

Instead of the McBride scorecard, which has been used by courts for a long time, the

rate of loss of work ability was determined.

오랜기간 법원에서 사용해 오던 맥브라이드 평가표를 대신해 노동능력 상실률을 결정한

것이다.

The judge pointed out that "The McBride table reflects the social environment of

the United States in the 1960s as it is, so it is mostly limited to manual labor, and there

is a big gap with the occupational patterns of modern Korean society, which is

a knowledge and information society."

재판부는 “맥브라이드 표는 1960년대 미국의 사회환경이 그대로 반영된 것이어서 대부분

육체노동에 한정되고 지식정보사회인 현대 한국사회의 직업양태와는 큰 간극이 있다”고

지적했다.
