Discretionary submissions can be seized without a warrant.

임의제출물은 영장 없이 압수가 가능하다.

However, if randomness is not recognized when taking into account the details of

the submission and the statements of the confiscated persons, it is an illegal

forced investigation.

그러나 제출 경위, 피압수자의 진술 등을 고려할 때 임의성이 인정되지 않는다면 위법한

강제수사가 된다.

Prosecutors or judicial police officers may confiscate, search or verify without a

warrant only within 24 hours from the time of arrest if it is necessary to urgently

confiscate the objects owned, possessed or kept by the arrested person.

검사 또는 사법경찰관은 체포된 자가 소유ㆍ소지 또는 보관하는 물건에 대하여 긴급히

압수할 필요가 있는 경우에는 체포한 때부터 24시간 이내에 한하여 영장 없이 압수ㆍ수색

또는 검증을 할 수 있다.

The prosecutor or judicial police officer shall request a seizure and search warrant

without delay if it is necessary to continue seizure of the confiscated goods.

검사 또는 사법경찰관은 압수한 물건을 계속 압수할 필요가 있는 경우에는 지체 없이

압수수색영장을 청구하여야 한다.

In this case, the request for a seizure and search warrant shall be made within 48

hours from the time of arrest.

이 경우 압수수색영장의 청구는 체포한 때부터 48시간 이내에 하여야 한다.

If the prosecutor or judicial police officer fails to issue the requested seizure and

search warrant, he/she shall immediately return the seized goods.

검사 또는 사법경찰관은 청구한 압수수색영장을 발부받지 못한 때에는 압수한 물건을 즉시

반환하여야 한다.
