There are cases when the depositor has made the deposit due to error or the cause of

the deposit has ceased to exist.

공탁자가 착오로 공탁하거나 공탁의 원인이 소멸한 경우가 있다.

In this case, before the depositor recovers the deposit, he or she must receive an order

for the depository's transfer request for issuance of the deposit.

이때에는 공탁자가 공탁물을 회수하기 전에 피공탁자의 공탁물출급청구권에 대한

전부명령을 받아야 한다.

In addition, the person who has received the deposit shall bear the obligation to return

unfair profits to the depositor.

그리고 공탁물을 수령한 자가 공탁자에 대하여 부당이득반환의무를 부담한다.
