Once a valid design right is established, it may be invalidated due to legal reasons.

이를 이유로 심판절차에 의하여 소급적 또는 장래를 향하여 그 효력을 상실시키는 것이다.

이러한 준사법적 행정절차를 디자인등록무효심판이라 한다.

Only interested parties or examiners can make a claim.

이해관계인 또는 심사관만이 청구가 가능하다.

The presence or absence of an interest is a matter of ex officio investigation and is

judged based on a trial decision.

이해관계의 유무는 직권조사사항이며 심결시를 기준으로 판단한다.

If the design right at the time of the request for invalidation trial becomes a claimee

and the design right is shared, all of the sharers shall be the claimee.

무효심판 청구 당시의 디자인권자가 피청구인이 되고 디자인권이 공유인 경우에는 공유자

전원을 피청구인으로 해야 한다.

In the case of multiple designs, each design exists as an independent right, so each

design must be claimed.

복수디자인의 경우 각 디자인마다 독립된 권리로 존재하므로 각 디자인마다 청구하여야 한다.

In the case of a related design, it is possible to request an invalidation trial only for

the related design because it has its own right.

관련디자인의 경우 독자적인 권리를 갖는 권리이므로 관련디자인에 한해서 무효심판

청구도 가능하다.
