The Health Insurance Corporation appealed to the license-lending pharmacist in order

to receive unfair benefits through a civil lawsuit, but the Supreme Court dismissed it.

건강보험공단이 면허대여 약사에게 민사소송으로 부당이득금을 받아 내기 위해 상고를

했지만 대법원이 이를 기각했다.

The Supreme Court recently filed an appeal on unfair gains by the Corporation, saying,

"In this case only the Corporation appealed, on the principle of prohibiting the change

of disadvantages, the original court ruling remains the same and dismisses

the Corporation's appeal.“

대법원은 최근 공단이 제기한 부당이득금 관련 상고심에서 "공단만이 상고한 이 사건에서

불이익 변경금지 원칙상 원심 판결을 그대로 유지해 공단의 상고를 기각한다."고 판시했다.

In a lawsuit, dismissal is a judgment or decision that rejects a claim by the plaintiff or

an appeal by the appellant because there is no reason.

기각은 소송에서 원고의 소에 의한 청구나 상소인의 상소에 의한 불복신청을 이유가

없다고 하여 배척하는 판결 또는 결정이다.

Dismissal under the Civil Procedure Act or the Administrative Procedure Act that

applies mutatis mutandis is the main decision.

민사소송법이나 이를 준용하는 행정소송법 등에서의 기각은 본안판결이다.

It had all the formal elements necessary for the lawsuit, but when the contents

were reviewed, it was determined that there was no reason to file a lawsuit.

소송에 필요한 형식적인 요소는 모두 갖추었으나 내용을 심사했더니 소를 제기할 이유가

없다고 판단한 것이다.

Since there is a reason for disqualification in the formal element, the rejection is

rejected without even considering.

각하는 아예 형식적인 요소에서 결격사유가 있어서 심리도 하지 않고 거부해버리는 것이다.
