There is a precedent on whether a third party can participate in a joint lawsuit in a

lawsuit for confirming invalidity of the board resolution of a school corporation.

학교법인의 이사회결의 무효 확인의 소에 제3자가 공동소송참가를 할 수 있는지에 관하여

판례가 있다.

Participation in a joint litigation is when the purpose of a lawsuit between another

person is determined jointly against one party and a third party.

공동소송참가는 타인간의 소송의 목적이 당사자 일방과 제3자에 대하여 합일적으로

확정될 경우이다.

In other words, it is limited to cases where the effect of a judgment on a lawsuit

between another person extends to a third party.

즉, 타인간의 소송의 판결의 효력이 제3자에게도 미치게 되는 경우에 한한다.

Only in this case, it is allowed to the third party.

이 같은 경우에 한하여 그 제3자에게 허용되는 것이다.

There is no separate provision in the law regarding the case where the resolution of

the board of directors of the school corporation is defective.

학교법인의 이사회의 결의에 하자가 있는 경우에 관하여 법률에 별도의 규정이 없다.

Therefore, if there are reasons for invalidation of the resolution, the interested party

may claim the invalidity at any time or by any means.

그러므로 그 결의에 무효사유가 있는 경우에는 이해관계인은 언제든지 또 어떤 방법에

의하든지 그 무효를 주장할 수 있다.
