In this case, the accomplice cannot be exempted from the guilt not only for

the commission amount of his own, but also for the commission amount of

other accomplices.

이 경우에 공범자는 자기의 수뢰액 뿐만 아니라 다른 공범자의 수뢰액에 대하여도 그

죄책을 면할 수 없다.

When determining whether or not to apply the Aggravated Punishment Act for a

specific crime, the sum of the commissions of all the accomplices shall be the basis.

특정범죄 가중처벌법의 적용 여부를 가리는 수뢰액을 정함에 있어서는 그 공범자 전원의

수뢰액을 합한 금액을 기준으로 하여야 한다.

It is not based on the amount each accomplice actually acquires or the amount

they choose to receive.

각 공범자들이 실제로 취득한 금액이나 분배받기로 한 금액을 기준으로 할 것이 아니다.

As public officials, 甲 and 乙 are in charge of cracking down on entertainment bars.

甲과 乙은 공무원으로서 유흥주점을 단속하는 업무를 담당하고 있다.

They conspired to accept bribes.

그들은 뇌물을 수수하기로 공모하였다.

So, they went to the 丙 who runs an entertainment bar.

그래서 그들은 유흥주점을 운영하는 丙을 찾아갔다.

There, they received a bribe of 40 million won to avoid the crackdown.

그곳에서 그들은 단속을 무마해 달라는 취지의 뇌물 4,000만 원을 수수하였다.

After returning to the office, 甲 and 乙 each had 20 million won.

사무실로 돌아간 후 甲, 乙은 각자 2,000만 원씩 나누어 가졌다.

乙 deposited the money directly into his savings account.

乙은 그 돈을 바로 자신의 예금계좌에 입금하였다.

However, after a week, 乙 received remorse and returned the full amount to 丙.

그러나 乙은 일주일 뒤 양심의 가책을 받아 丙에게 전액 반환하였다.

甲, 乙, and 丙 are being tried as co-defendants for the above crimes.

甲, 乙, 丙은 위와 같은 범죄사실로 공동피고인으로 재판중이다.

In this case, the amount that 甲 and 乙 received as a bribe was 40 million won.

이 사례에서 甲과 乙이 뇌물로 받은 금액은 4,000만 원이다.

Therefore, even if each of them is divided by 20 million won, it is equal to or more than

30 million won, which is the amount of bribery subject to the Act on

Aggravated Punishment for Specific Crimes.

그러므로 이것을 각자 2,000만 원씩 나누어 가졌더라도 특정범죄 가중처벌 등에 관한

법률의 적용대상 뇌물가액인 3,000만 원 이상에 해당한다.

Therefore, they are jointly subject to bribery under the Special Aggravated Act.

따라서 공동으로 특가법상 뇌물죄 적용을 받는다.
