When the administrative agency intends to impose a fine for violating order, it shall

first notify the parties in advance and give them an opportunity to submit their opinions.

행정청이 질서위반행위에 대하여 과태료를 부과하고자 하는 때에는 먼저 당사자에게

사전통지하고, 의견을 제출할 기회를 주어야 한다.

In addition, the establishment of violations of order and the disposition of fines

for negligence shall be in accordance with the laws of the act.

그리고 질서위반행위의 성립과 과태료의 처분은 행위시의 법률에 따라야 한다.

If there is no intention or negligence of the parties, a fine cannot be imposed.

만일 당사자의 고의 또는 과실이 없는 질서위반행위라면 과태료를 부과할 수 없다.

In addition, no fine for negligence shall be imposed for any act that is not in

accordance with the law.

아울러 법률에 따르지 아니하고는 어떤 행위도 질서위반행위로 과태료를 부과하지 아니한다.

In particular, the administrative agency's imposition of a fine for negligence is not

subject to appeal proceedings under the Administrative Procedure Act.

특히 행정청의 과태료부과행위는 행정소송법상 항고소송의 대상이 되지 아니한다.
