When the administrative agency intends to impose a fine for violating order, it shall
first notify the parties in advance and give them an opportunity to submit their opinions.

If there is no intention or negligence of the parties, a fine cannot be imposed.

In addition, no fine for negligence shall be imposed for any act that is not in
accordance with the law.

In particular, the administrative agency's imposition of a fine for negligence is not
subject to appeal proceedings under the Administrative Procedure Act.
