제3자를 위한 계약이란 계약은 당사자끼리 체결하고 그로 인한 수익은 당사자가 아닌

제3자로 하여금 직접 취득하게 하는 것이다.

A contract for a third party means that a contract is concluded between the parties,

and the resulting profits are directly acquired by a third party, not the parties.

계약을 요청한 사람을 요약자, 요약자의 요구를 승낙한 사람을 낙약자, 수익을 받을 사람인

제3자를 수익자라고 한다.

The person who requests the contract is called the requester, the person who accepts

the request of the requester is called the accepter, and the third party who will receive

the profit is called the beneficiary.

수익자는 계약 당시 현존할 필요가 없으며, 태아도 가능하고, 설립 중인 법인이어도 무방하다.

Beneficiaries do not need to be present at the time of the contract, fetuses are

possible, and corporations under establishment may be sufficient.

예컨대, 태어날 아이를 위해 부모가 드는 태아보험이 그러하다.
