New Year's Insurance Contract Changes to “Obligation of Notification”

In the new year, the government and the National Assembly change the
“voluntary notification obligation” of policyholders to “response notification
obligation” through amendments to the Commercial Law.

Accordingly, if the policyholder answers all written questions from the insurance
company, it is considered to have faithfully fulfilled the notification obligation without
a separate “voluntary report”.

ruled against the plaintiff in a lawsuit to confirm the absence of a debt against Kang by
H Insurance, which refused to pay gastric cancer treatment fees because he did not
inform that he received gastritis treatment at the time of the insurance contract.

The judge said in the ruling, “It is admitted that Mr. Kang did not include the fact that
he suffered from gastritis in the insurance contract. However, there is no obligation
to notify the insurance company of the minor illness that the subscriber was treated
for two days before the insurance contract.”
