다이어트 보조제의 효능을 과장했다는 혐의를 받아 재판에 넘겨진 유명 유튜버 밴쯔(본명 정만수)에 대해 법원이 항소 抗訴를 기각하고 벌금 500만원을 선고한 1심 판결을 확정했다.

The court rejected the appeal against the famous YouTuber Bantz (real name, Man-Soo Jung), who was charged with exaggerating the effects of dietary supplements, and confirmed the first trial, which resulted in a fine of 5 million won.

항소는 재판에서 제1심 법원의 판결에 불복 不服하는 것이다.

An appeal is a disagreement with the judgment of the first instance court in a trial.

즉 불복의 경우 상급 법원에 재심 再審을 청구하는 법적 절차이다.

In other words, in case of dissatisfaction, it is a legal process to request a reconsideration in the superior court.

제1심에 제기하는 것을 '항소 抗訴'라고 한다.

The appeal to the first trial is called an 'appeal'.

그리고 항소심의 판결에 불복하는 경우를 '상고 上告'라고 한다.

And the case of disobedience to the judgment of the appeal is called an 'appeal'.

항소는 당사자 當事者나 당사자의 법률적 대리인만이 할 수 있다.

An appeal may only be made by either the party or its legal representative.

항소에 대한 판결은 요건을 갖추지 못했을 때에는 각하 却下한다.

The judgment on the appeal is dismissed if the requirements are not met.

반면에 제1심 판결에 문제가 없을 때에는 기각 棄却한다.

On the other hand, if there is no problem with the judgment of the first trial, it is rejected.

민사소송법 제415조는 항소 抗訴를 받아들이는 범위에 관한 규정이다.

Article 415of Civil procedure act stipulates the scope of admitting appeal.

이 조항은 “제1심 판결은 그 불복 不服의 한도 안에서 바꿀 수 있다.”고 규정하고 있다.

This article stipulates “A judgment of the first instance may be altered within the extent of dissatisfaction therewith.”

다만 “상계 相計에 관한 주장을 인정한 때에는 그러하지 아니하다.”고 단서를 달고 있다.

But this article has a provisory clause of “That the same shall not apply when the allegation as to an offset has been admitted.”
