양도금지특약이란 채권에 타인에게 양도할 수 없다는 단서를 달아둔 것을 말한다.

A non-transfer special agreement refers to a credit with a clue that it cannot be transferred to another person.

민법 제449조는 채권의 양도성에 대해 규정하고 있다.

Article 449 of Civil Code provides ‘Assignability Nature of Claim.’

이 조항은 제①항에서 “채권은 양도할 수 있다. 그러나 채권의 성질이 양도를 허용하지 아니하는 때에는 그러하지 아니하다.”고 규정하고 있다.

This article at (1) clause provides “A claim may be assigned, except where its nature does not so permit.”

이어 제②항은 “채권은 당사자가 반대의 의사를 표시한 경우에는 양도하지 못한다. 그러나 그 의사표시로써 선의의 제삼자에게 대항하지 못한다.”고 규정하고 있다.

And (2) clause provides “Where the parties have declared a contrary intention, a claim shall not be assigned. Provided, That such declaration of intention, cannot be set up against a third person acting in good faith.

당사자 사이에 양도금지의 특약이 있는 채권이 있다.

There is a credit between the parties with a special non-transfer agreement.

그러하더라도 전부명령에 의하여 전부되는 데에는 지장이 없다.

Even so, there is no hindrance to being done by transfer orders.

그리고 양도금지의 특약이 있는 사실에 관하여 집행채권자가 선의인가 악의인가는 전부명령의 효력에 영향을 미치지 못한다.

In addition, with regard to the fact that there are special provisions for the transfer, whether the executive creditor is good or bad does not affect the effectiveness of the transfer order.
