민사소송법상 소의 취하는 소를 제기한 자가 법원에 대해 행하는 의사표시이다.

Under the Civil Procedure Act, withdrawal of lawsuit is an intention to act against the court by a person who filed a lawsuit.

즉 소 제기자가 법원에 요구한 심판의 일부 一部 또는 전부 全部를 철회하는 것이다.

In other words, part or all of the judgments requested by the petitioner are withdrawn.

민사소송법 제266조는 소의 취하 규정이다. Article 266 of CIVIL PROCEDURE ACT provides Withdrawal of Lawsuit.

이 규정은 “소는 판결이 확정 確定될 때까지 그 전부나 일부를 취하할 수 있다.”고 정하고 있다.

This rule stipulates that “A lawsuit may be wholly or partially withdrawn, before judgment becomes final and conclusive.”

판례를 살핀다. Look at the precedent. 원고가 소를 취하했다. The plaintiff withdrawn the lawsuit.

이에 대하여 피고가 이의를 제기했다. The defendant objected to this.

즉 소 취하에 대한 동의 同意를 거절했다. That is, he refused to agree to the cancellation.

그렇다면 소 취하 효력을 발생할 수 없다. If so, the cancellation cannot be effective.

후에 동의하더라도 취하의 효력이 없다. Even if he later agree, it will not take effect.
