세무당국은 소송 이외의 회사에 대하여 원고와의 주류 거래를 일정기간 중지하여 줄 것을 요청했다.

Tax authorities have asked companies other than the lawsuit to suspend liquor transactions with plaintiffs for a period of time. 

이 같은 행위가 항고소송의 대상이 될 수 있는지가 의문이다. 

The question is whether such an act could be the subject of an appeal lawsuit. 

이에 대해 쟁점이 된 사례가 있다. Here is an example of the issues that have been raised.

항고소송의 대상이 되는 행정처분은 행정청의 공법상의 행위이다. 

Administrative action that is the subject of appeal proceedings is an administrative act of the Public Administration. 

상대방 또는 기타 관계자들의 법률상 지위에 직접적으로 법률적인 변동을 일으키는 행위를 말하는 것이다. 

It refers to an act that directly causes legal changes in the legal status of the other party or other relevant persons. 

그러나 세무당국이 소송 이외의 회사에 대하여 원고와의 주류거래를 일정기간 중지하여 줄 것을 요청한 행위는 다른 성격이다. 

However, the act of requesting that the tax authorities suspend liquor transactions with plaintiffs for a period of time against companies other than lawsuits is of a different nature.

권고 내지 협조를 요청하는 권고적 성격의 행위이다. 

It is an act of advisory nature that seeks advice or cooperation. 

소송 이외의 회사나 원고의 법률상의 지위에 직접적인 법률상의 변동을 가져오는 행정처분이라고 볼 수 없는 것이다. 

It cannot be regarded as an administrative measure that causes direct legal changes in the legal status of a company or plaintiff other than a lawsuit. 

그러므로 항고소송의 대상이 될 수 없다. 

Therefore, it cannot be the subject of an appeal lawsuit.

행정소송법 ADMINISTRATIVE LITIGATION ACT 제2조(정의) Article 2 (Definitions) ①이 법에서 사용하는 용어의 정의는 다음과 같다. 

For the purpose of this Act, the definitions of terms shall be as follows: 

1. "처분등"이라 함은 행정청이 행하는 구체적 사실에 관한 법집행으로서의 공권력의 행사 또는 그 거부와 그 밖에 이에 준하는 행정작용(이하 "處分"이라 한다) 및 행정심판에 대한 재결을 말한다. 

The term "disposition, etc." means the exercise of or refusal to exercise public authority by an administrative agency as function of law enforcement in relation to a specific fact, 

other similar administrative actions (hereinafter referred to as the "disposition") and an adjudication on the administrative appeal; 

2. "부작위"라 함은 행정청이 당사자의 신청에 대하여 상당한 기간 내에 일정한 처분을 하여야 할 법률상 의무가 있음에도 불구하고 이를 하지 아니하는 것을 말한다. 

The term "omission" means the failure of an administrative agency to take a certain disposition for a reasonable period of time, notwithstanding its legal obligation to do so, in response to an application filed by a party. 

②이 법을 적용함에 있어서 행정청에는 법령에 의하여 행정권한의 위임 또는 위탁을 받은 행정기관, 공공단체 및 그 기관 또는 사인이 포함된다. 

In application of this Act, the term "administrative agencies" shall include administrative organs, public entities and their organs or private persons delegated or commissioned with administrative power under Acts and subordinate statutes.
