comment : 강행규정은 그 효력에 있어서 단속규정과 구별된다. 양자는 다 같이 일정한 행위를 금지하는 규정이다. 다만 단속규정은 그 위반 행위를 한 자에 대하여 제재를 가하여 금지하는데 그칠 뿐이다. 그러나 강행규정은 그 사법상의 효과를 부인한다. 강행규정을 강행법규 혹은 강제법규나 강제규정으로 부르는 경우도 있다.
