주주대표소송에서 승소한 주주는 피고에 대하여만 소송비용을 청구할 수 있는 것이 아니라 회사에 대하여도 소송비용을 청구할 수 있다.

위증죄

甲이 제9회 공판기일에 증인으로 출석하여 선서한 후 기억에 반하는 허위 진술한 것을 철회·시정한 바 없이 증인신문절차가 그대로 종료되었다.

On the 9th trial date, the witness examination procedure ended without withdrawal or correction of any false statements contrary to the memory after presenting as a witness and taking an oath.

그 후 다시 증인으로 신청된 甲이 위 사건의 제21회 공판기일에 다시 출석하여 선서하였다.

After that, the person who applied as a witness again appeared on the 21st trial date of the above case and sworn.

그 후 종전의 제9회 기일에서 한 진술이 허위 진술임을 시인하고 이를 철회하는 취지의 진술을 하였다.

After that, he admitted that the statement made on the previous 9th date was a false statement and made a statement with the intention of withdrawing it.

그렇다면 甲에게 위증죄가 성립한다.

If so, the crime of perjury is established for 甲.

과잉금지원칙

Excessive prohibition rule

검정고시에 합격했던 자가 해당 검정고시에 다시 응시할 수 없게 됨으로써 제한되는 주된 기본권은 자유권적 기본권이다.

The main basic right, which is limited as a person who passed the GED cannot take the GED again, is the basic right of freedom.

이러한 응시자격 제한은 검정고시제도 도입 이후 허용되어 온 합격자의 재응시를 경과조치 등 없이 무조건적으로 금지하는 것이다.

This restriction on eligibility for the examination is to unconditionally prohibit retakes of successful applicants who have been allowed since the introduction of the examination system.

따라서 과잉금지원칙에 위배된다.

Therefore, it violates the rule of excessive prohibition.
