주신문에서는 유도신문이 원칙적으로 허용되지 않는다.

In principle, inducing questionings are not allowed in the main questing.

그러나 반대신문에서는 유도신문이 허용된다.

However, inducing questionings are permitted in counter questing.

증인신문은 각 증인에 대하여 신문하여야 한다.

The witness questioning must examine each witness.

신문하지 아니한 증인이 재정한 때에는 퇴정을 명하여야 한다.

When a witness who has not been examined is remained in the court, 

an order shall be made to retire.

증인이 16세 미만일 경우 선서하게 하지 아니하고 신문하여야 한다.

Where witnesses are under the age of 16, they shall be examined 

without making an oath.

또한 법원이 13세 미만의 피해자를 증인으로 신문하는 경우도 있을 수 있다.

이 경우에는 재판에 지장을 초래할 우려가 있는 등 부득이한 경우가 아닌 한 피해자와 신뢰관계에 있는 자를 동석하게 하여야 한다.

 interfere with the trial.

이외에도 공무원과 관련하여 증인신문이 문제가 된다.

여기서는 공무원뿐만 아니라 공무원이었던 자도 포함된다.

그들이 그 직무에 관하여 알게 된 사실들이 있다.

그리고 그 사실들에 관하여 본인 또는 당해 공무소가 직무상 비밀에 속한 사항임을 신고한 때가 있다.
