서증을 신청한 당사자가 문서의 사본을 서증으로 제출하였다.

The person who applied for the documentary evidence submitted a copy of the

 document as deed.

이 경우 문서 원본의 제출이 불가능한 상황이다.

In this case, the original document cannot be submitted.

이러한 상황에서는 원본의 제출이 요구되는 것은 아니다.

Submission of the original is not required in these circumstances.

하지만, 이러한 때에는 해당 서증의 신청 당사자가 원본 부제출을 정당화할 수 있는 구체적 사유를 주장·증명하여야 한다.

However, in such a case, the party applying for the declaration must assert and 

prove specific reasons justifying that cannot the submission of the original.

민법상 사단법인 총회 등의 결의에 관한 의사정족수나 의결정족수의 충족 여부가 다투어진다.

According to the civil law, it is disputed whether the quorum of decisions or the

 quorum of decisions regarding resolutions of the general meeting of an incorporated 

corporation is satisfied.

즉 총회결의의 성립 여부가 문제되는 경우이다.

In other words, it is a case of questioning whether the resolution of the general

 assembly is established.

이 경우 특별한 사정이 없는 한 의사정족수 등 절차적 요건의 충족 여부는 제출된 의사록 등의 기재에 의하여 판단하여야 한다.

In this case, unless there are special circumstances, whether or not procedural

 requirements, such as a quorum of decision, are satisfied, shall be judged by 

writing the submitted minutes.

그리고 그 의사록 등의 증명력을 부인할 만한 특별한 사정은 결의의 효력을 다투는 측에서 구체적으로 주장·증명하여야 한다.

In addition, any special circumstances that deny the proof of the minutes, etc., 

must be specifically asserted and proved by the party who disputes the validity 

of the resolution.
