의사표시의 착오가 표의자의 중대한 과실로 이루어졌다.

그런데 이때에 상대방이 표의자의 착오를 알고 이용하였다.

But at this time, the other party knew and used the mistake of the person to express the

 intention.

이러한 경우에도 표의자는 그 의사표시를 취소할 수 있다.

Even in such a case, the person to express the intention may cancel the expression of 

intention.

장래의 미필적 사실의 발생에 대한 기대나 예상이 빗나간 것에 불과하다.

Expectations or predictions about the occurrence of unknown facts in the future are

 simply misplaced.

이러한 것은 착오라고 할 수 없다.

This cannot be called an error.

표의자가 착오로 인하여 경제적인 불이익을 입은 것이 아니다.

It is not that the person who expresses the intention suffered an economic penalty 

due to an error.

그렇다면 이를 법률행위 내용의 중요부분의 착오라고 할 수 없다.

If so, this cannot be called a mistake in the important part of the legal action.

표의자가 경과실로 인하여 착오에 빠져 법률행위를 하였다.

The person to express the intention committed a legal act due to a light error.

그리고 그 착오를 이유로 법률행위를 취소하였다.

And the legal act was canceled due to the mistake.

이는 위법하다고 할 수 없다.

This cannot be called illegal.

착오로 인한 의사표시 취소에 관한 민법 규정이 있다.

There are civil law regulations on the cancellation of the expression of intention due to an error.

이 규정의 적용을 당사자의 합의로 배제할 수 있다.

The application of this regulation may be excluded by agreement of the parties.
