Legal benefits can be seen in three ways.

법률상 이익은 세가지로 볼 수 있다.

First, it is a legal interest that is protected by the provisions of the relevant laws

and regulations.

첫째, 당해 처분의 근거법규의 규정에 의하여 보호받는 법률상 이익이다.

Second, it is not protected by the underlying laws and regulations of the disposition.

둘째, 당해 처분의 근거법규에 의하여 보호되지는 아니한다.

However, it is a legal interest that is explicitly protected by the underlying laws

and regulations of a series of step-by-step related dispositions to achieve

the administrative purpose of the disposition.

그러나 당해 처분의 행정목적을 달성하기 위한 일련의 단계적인 관련처분들의 근거법규에

의하여 명시적으로 보호받는 법률상 이익이다.

Third, there are no provisions that explicitly protect the interests in the relevant laws

or regulations of the disposition.

셋째, 당해 처분의 근거법규 또는 관련법규에서 명시적으로 당해 이익을 보호하는 규정이

없다.

Even so, it refers to cases where it is interpreted that the reason for restricting

the administrative agency in the legal interpretation of the underlying laws and

related laws includes not only the protection of pure public interests, but the purpose

of protecting individual, direct, and specific interests.

그러하더라도 근거법규 및 관련법규의 합리적 해석상 그 법규에서 행정청을 제약하는

이유가 순수한 공익의 보호만이 아닌 개별적 · 직접적 · 구체적 이익을 보호하는 취지가

포함되어 있다고 해석되는 경우까지를 말한다.
