윤총장 업무 복귀에 따라 월성원전 수사가 탄력을 받을 것이라는 예상과 ‘통치행위’라는

주장이 엇갈리고 있다.

The expectation that the investigation of the Wolseong Nuclear Power Plant will

receive momentum with the return of General Yoon's work is mixed with the claim that

it is a “governmental act”.

'어떤 행위가 사법적 판단 영역에 해당하는지'를 최종적으로 결정할 권한을 가지는 법원과

헌법재판소는 정부의 정책 결정·집행과 같은 이른바 '통치행위'에 대해선 사법기관의

개입이 최대한 자제돼야 한다는 판단을 내린 바 있다.

The courts and the Constitutional Court, which have the power to finally determine

'what acts fall within the sphere of judicial judgment', decided that the intervention

of judicial institutions should be restrained as much as possible in so-called

'governmental acts' such as government policy decisions and execution.

다만 대법원과 헌재는 통치행위와 관련된 모든 행위가 사법적 판단 대상에서 제외되는

것은 아니라는 견해도 밝힌 바 있다.

However, the Supreme Court and the Constitution also expressed the view that not

all actions related to governing acts are excluded from judicial judgment.

대법원은 "남북정상회담의 개최 과정에서 재정경제부 장관에게 신고하지 아니하거나

통일부 장관의 협력사업 승인을 얻지 아니한 채 북한 측에 사업권의 대가 명목으로 송금한

행위 자체는 사법심사의 대상이 된다."고 판단했다.

The Supreme Court said, "In the process of holding the inter-Korean summit, the act

of remittance in the name of business rights to the North Korean side without reporting

to the Minister of Finance and Economy or obtaining approval for a cooperative

project from the Minister of Unification, it is the subject of judicial review."

뿐만 아니라 통치행위 자체가 국민의 기본권을 직접적으로 침해하는 경우에도 사법적 판단

대상이 될 수 있다고도 보고 있다.

In addition, it is believed that even if the act of governing itself directly infringes on

the basic rights of the people, it may be subject to judicial judgment.
