Eumseong-gun secures ownership of unregistered road land

Eumseong-gun recently secured a number of ownership by tracking land that
had completed compensation according to the road project 20 years ago, but
the ownership was not transferred.

According to the Construction and Transportation Division of Eumseong-gun, it
was announced that ownership of 26,000,737 square meters of 112 lots of land that
had been omitted at the time of various road construction before 1998 was transferred.

When preservation registration is performed, a registration document for the real estate
is newly opened, and all changes in rights regarding this real estate will be recorded
on this registration document in the future.

However, there are cases in which ownership preservation registration is duplicated
as registration documents are opened separately for the same real estate.

This is called redundant preservation registration.

The Supreme Court interprets that duplicate preservation registration is invalid.
±×°ÍÀÌ ºÎµ¿»êÀÇ ¸Å¼öÀο¡ ÀÇÇÏ¿© ÀÌ·ç¾îÁø °æ¿ì¿¡µµ ¸¶Âù°¡Áö·Î º»´Ù.
The same shall apply if it is made by the buyer of the real estate.

However, it is limited that the original preservation registration should not be invalid
in cause.
