Eumseong-gun secures ownership of unregistered road land

음성군이 20여년전 도로사업에 따라 보상을 완료했으나 소유권이 이전되지 않았던 토지를

추적해 최근 소유권을 다수 확보했다.

Eumseong-gun recently secured a number of ownership by tracking land that

had completed compensation according to the road project 20 years ago, but

the ownership was not transferred.

음성군 건설교통과에 따르면, 98년도 이전 각종 도로 공사 당시 등기 이전이 누락됐던

토지 112필지 2만6천737㎡의 소유권을 이전 등록했다고 밝혔다.

According to the Construction and Transportation Division of Eumseong-gun, it

was announced that ownership of 26,000,737 square meters of 112 lots of land that

had been omitted at the time of various road construction before 1998 was transferred.

보존등기는 미등기부동산에 최초로 하는 등기이다.

Preservation registration is the first registration of unregistered real estate.

보존등기를 하게 되면 그 부동산에 관한 등기용지가 새로 개설되며, 향후 이 부동산에 관한

권리변동 사실이 모두 이 등기용지에 기재되게 된다.

When preservation registration is performed, a registration document for the real estate

is newly opened, and all changes in rights regarding this real estate will be recorded

on this registration document in the future.

그런데 동일한 부동산에 대해 등기용지가 따로 개설되면서 소유권보존등기가 중복으로

되는 경우가 있다.

However, there are cases in which ownership preservation registration is duplicated

as registration documents are opened separately for the same real estate.

이를 중복보존등기라고 한다.

This is called redundant preservation registration.

대법원은 중복보존등기는 무효라고 해석한다.

The Supreme Court interprets that duplicate preservation registration is invalid.

그것이 부동산의 매수인에 의하여 이루어진 경우에도 마찬가지로 본다.

The same shall apply if it is made by the buyer of the real estate.

다만 원래의 보존등기가 원인무효가 아니어야 한다고 제한하고 있다.

However, it is limited that the original preservation registration should not be invalid

in cause.
